Terms and Conditions

Thank for your interest is commissioning a free proof-of-capability prototype. We encourage you to please review the terms and conditions that apply to a free rapid prototype:

Copyright

1) The ownership of content (text and conceptual images provided by the prospective client) will at all times belong to the prospective client. A non-disclosure agreement will be signed before a free rapid prototype is scheduled.

2) Notwithstanding clause 1, the actual prototype will not be used for further commercial gains by commissioning party, unless it is converted into a paid-project. Also, unless the prototype is paid for, the prototype can be publicly displayed only when credit for design and development is attributed to 42 Design Square, LLC.

3) Notwithstanding clause 1 and 2, 42 Design Square reserves the right to reuse the graphic assets created by it. However, if the prototype is converted into a paid-project, graphic assets will be reused only on the projects of that particular client.

Scope and Timeline

1) 42 Design Square, LLC reserves the right to determine the scope of the free rapid prototype.

2) The client will provide the content for the free rapid prototype in digital format.

3) If due to extraneous and uncontrollable factors, the free rapid prototype cannot be delivered in the communicated time period, 42 Design Square LLC will not be liable to any penalty or claims of compensation. An extension of timeline will be communicated as early as possible to the commissioning party.

4) Once a rapid prototype has been delivered, the further changes in scope or design will be made only if a paid-project is commissioned. Source files of the rapid prototype will be transferred only when the free prototype converts into a full-fledged project.
